Kerry Hadaway, Barrister
Specialising in criminal and traffic law
As a criminal defence lawyer, it’s my job to ensure that your rights are protected and your voice is heard in the legal system. I will advocate for you strongly in court.
I believe in the importance of clear communication, so I'll make sure you understand every step of the process and all of your available options. Together, we'll build a strong defence strategy tailored to your unique circumstances.
Having worked on a wide range of cases, from defending drink driving charges through to allegations of serious sexual offending and murder, I've honed my skills both inside and outside the courtroom.
My background includes working as a criminal defence lawyer at the Public Defence Service (New Zealand’s biggest criminal law practice) for seven years. This included time spent as a legal team manager during which I trained and supervised junior lawyers.
I hold a Bachelor of Laws (LLB) and a Bachelor of Arts from Victoria University of Wellington.
I primarily work on Legal Aid, but I can also be instructed on a private basis. Reach out to me today for a confidential consultation to see how I can help.
I am a member of 109 Chambers, a group of barristers who operate independently but share an office space here in Hamilton. Our chambers website can be found here: 109Chambers
How I can help
Applying for discharge without conviction
I can assess your case and advise on whether you have grounds to apply to the court to not be convicted at sentencing. I can help you make this application by putting all of the relevant information before the court.
Applying for parole
I am approved by Legal Aid Services to take parole cases. I can help you to put your best foot forward before the New Zealand Parole Board.
Defending you at trial
I can defend you in Judge-alone trials or jury trials. I hold PAL 3 approval with Legal Aid Services, which means I can represent you on charges up to a maximum penalty of 20 years’ imprisonment. It also means that, for more serious charges, you can choose me as your preferred lawyer through Legal Aid.
Appealing your sentence
I can assess your case and advise you on whether the sentence the Judge gave you is too high, and, if so, I can represent you at the High Court.
Applying for bail
I understand how important getting bail is for you and your whānau. I can help you to make a bail application and put all of the relevant information about you before the Court.
Seeking a sentence indication hearing
We can go in front of a Judge before your trial and ask what your sentence would be. You can then decide if you want to accept what the Judge has said your sentence will be, or still go to trial.
